Requirements for confirming competence of employees in the field of industrial safety, safety of hydraulic structures, in the field of electric power and heat supply have been clarified


The President of the Russian Federation signed Federal Law No. 402-FZ dated December 8, 2020 “On Amendments to the Federal Law ‘On Electric Power Industry’ and Article 23-2 of the Federal Law ‘On Heat Supply’.”

The amendments are aimed at maintaining and further developing the sectoral system of work with personnel in the field of electric power and heat supply, including checking knowledge of the requirements for ensuring the reliability of electric power systems, the reliability and safety of power and heat supply facilities, as well as health safety requirements.

In addition, the Federal Law narrows the circle of persons who must pass certification on safety issues in the electric power industry in the order established by the Ordinance of the Government of the Russian Federation dated October 25, 2019 No. 1365 “Concerning training and certification in the field of industrial safety, safety of hydraulic structures, safety in the electric power industry.”. Such duties are now assigned only to the heads (deputy heads) of the electric power industry entities and consumers of electric power, in respect of which the federal state energy supervision is carried out.

On December 15, 2020, the Regulation on Certification Boards for certification in the field of industrial safety, safety of hydraulic structures, safety in the electric power industry, approved by Rostechnadzor Order No. 256 dated July 6, 2020 (registered by the Ministry of Justice of the Russian Federation on December 4, 2020, reg. No. 61253), comes into force.

The Regulation states:

1) powers, rights and duties of the certification boards;

2) requirements for the procedure for making decisions on certification issues;

3) requirements for the procedure for formation and composition of the certification boards.

The Regulation governs the activities of the territorial certification boards and the central certification board, and the certification boards of the organizations.

In particular, the Regulation determines the quantitative composition of the certification boards of Rostechnadzor, while the quantitative composition of an organization’s certification board must be established by the organization’s local regulatory act.

The Regulation also provides that the functions of a secretary in an organization’s certification board may be performed by a person who is not a member of the board.
