Clarifications on the implementation of the Ordinance of the Government of the Russian Federation of 03.04.2020, No. 440 “Concerning Extension of Permits and Other Specifics Regarding Permitting Activities in 2020”
In order to protect public health and prevent the spread of coronavirus infection, Federal Environmental, Industrial and Nuclear Supervision Service (Rostechnadzor), in pursuance of the assignments from the President and the Government of the Russian Federation, implements, taking into account its powers, a set of measures to support economic entities. As part of this work, Rostechnadzor took part in the preparation of the Ordinance of the Government of the Russian Federation of 03.04.2020, No. 440 “Concerning Extension of Permits and Other Specifics Regarding Permitting Activities in 2020” (hereinafter referred to as Ordinance).
The Ordinance establishes the specifics of regulation of activities in the field of industrial safety, safety of hydraulic structures, and in the sphere of electric power and heat supply from April 3, 2020 to December 31, 2020.
Moratorium on the next certification
The existing certifications in the field of industrial safety, on the issues of safety of hydraulic structures, and safety in the sphere of electric power are extended and considered valid until October 1, 2020.
Until December 31, 2020, the period of initial certification calculated from the date of appointment is increased from one to three months.
In accordance with the Ordinance and the Order of Rostechnadzor dated 07.04.2020, No. 148 (hereinafter referred to as Order), the deadlines for the next certification of experts in the field of industrial safety to come in 2020 are extended by three months.
Moratorium on re-issuance of certain types of licenses
The Ordinance reduces the grounds for renewal of the licenses for the period until December 31, 2020: for the operation of fire explosive, fire hazardous, and chemically hazardous production facilities of hazard classes I, II, and III; on the activities related to the handling of industrial explosives; mine surveying activities; and industrial safety reviews.
These licenses are not subject to renewal in cases related to:
- renaming of geographic locations, streets, squares, or other territories, and changing the numbering of buildings;
- reorganization of a legal entity in the form of transformation, merger, or absorption.
In addition, until December 31, 2020, the licenses for the operation of fore explosive, fire hazardous, and chemically hazardous production facilities of hazard classes I, II, and III; the licenses for activities related to the handling of industrial explosives are not subject to re-issue due to a change in the address of the place of the type of activity to be licensed.
The documents of the licensees falling within the scope of the Ordinance and being considered by Rostechnadzor will be returned to the applicants.
Moratorium on the next declaration of safety of hydraulic structures
Until December 31, 2020, the operation of hydraulic structures can be carried out without submission of the declaration of safety of hydraulic structures and their state review by their owners and/or their operating organizations to Rostechnadzor. These provisions do not affect the development of safety declarations for hydraulic structures as part of project documentation.
The Ordinance does not prohibit the submission of a declaration at the initiative of an owner or operating organization.
Knowledge test moratorium
Knowledge tests in the field of labor protection requirements and other safety requirements for the organization and performance of work in electrical installations will not be carried out until October 1, 2020.
Temporary connection of power installations without authorization
Until December 31, 2020, temporary reception (supply) of voltage and power during utility connection of power receiving devices, electric power production facilities, and power grid facilities to power grid facilities, temporary connection (utility connection) of a heat supply facility can be carried out without obtaining a permit authorizing operation issued by the authorized body of federal state energy supervision.
The Ordinance does not prohibit the organizations from applying for authorizing permits on their own initiative.
Remote Industrial Safety Review
Until July 1, 2020, the operation of hazardous production facilities can be carried out without conducting an industrial safety review of technical devices, buildings, and structures. The corresponding decision must be made by the head (deputy head) of the operating organization, or by the head of its separate structural unit (branch, representative office) – in cases when such rights are provided for by the regulation on such a separate unit. The form of such a decision (written or electronic document) is determined by the organization independently. The person who made the decision assumes all responsibility for the safe operation of technical devices, buildings, and structures, in respect of which the review was not carried out in a timely manner.
From July 1 to December 31, it is allowed to conduct industrial safety reviews of technical devices, buildings, and structures at hazardous production facilities using means of remote interaction of industrial safety experts and employees of the operating organizations. The forms of remote interaction are determined by the expert organization in consultation with the customer. When conducting a review using means of remote interaction, all requirements established by the existing legislation must be observed.
