The periods of validity of certain permitting regimes have been extended.
The Government of the Russian Federation has adopted Ordinance No. 1580 dated October 1, 2020 “Concerning Amending the Ordinance of the Government of the Russian Federation No. 440 dated April 3, 2020.” In order to ensure the normal operation of organizations in the context of the spread of a new coronavirus infection, the ordinance changes the validity periods for the application of certain permitting regimes in the field of industrial safety, safety of hydraulic structures, and in the field of electricity and heat supply.
The validity period, during which the implementation of activities on the operation of explosive and fire hazardous and chemically hazardous production facilities of hazard classes I, II and III and activities related to the circulation of industrial explosives is allowed without renewal of the relevant licenses due to a change in the address of the place of implementation of the licensed type of activity specified in the license, has been extended until January 1, 2022.
At the same time, already today, the licenses for these types of activities can be reissued in connection with a change in the address of the place of implementation of the licensed type of activity specified in the license, if the licensee submits a corresponding application.
The period, during which the existing certification in the field of industrial safety, safety of hydraulic structures, safety in the electric power industry is extended and considered valid, has been extended until July 1, 2021. At the same time, the organizations having employees with expired certification have the right to send them for certification to the territorial certification commissions or to the commissions of the organizations (depending on the category of an employee) on their own initiative.
In order to exclude cases of mass gathering of persons to be certified, the territorial bodies of Rostechnadzor will post recommended schedules for submitting applications for the next certification on their official websites.
Also, until July 1, 2021, the period has been extended when it is not required to test knowledge of labor protection requirements and other safety requirements for organizing and performing work in electrical installations, and testing knowledge of the requirements for the safe conduct of work at heating facilities. However, such a knowledge test can now be carried out on the appropriate initiative of a legal entity or individual entrepreneur.
Rostechnadzor pays special attention of the supervised organizations to the need for timely implementation of measures necessary for re-issuing the licenses, certification or knowledge test of the employees. Upon completion of the periods established by the Ordinance, non-compliance with the relevant mandatory requirements will become an offense entailing liability in accordance with the legislation of the Russian Federation.The Ordinance entered into force on October 5, 2020.
